Terms and Conditions

These Terms and Conditions ("Agreement") govern your use of the services provided by Home Services Growth Engine ("Company", "we", "our", or "us"). By purchasing or using our services, you ("Client", "you", "your") agree to be bound by this Agreement.
1. Scope of Services
We provide digital marketing services primarily focused on local SEO for home service businesses. These may include, but are not limited to:
- New website creation
- Google Business Profile optimization
- Google Maps (local pack) SEO services
- City page creation
- Content publishing
- CRM, automation, call tracking, form capture, and email tools via our platform
- Add-on services such as expanded radius targeting, commercial keyword support, Google Ads, and more
Service features vary depending on your selected plan and add-ons.
2. Client Responsibilities
To ensure timely and effective delivery of services, you agree to:
- Complete the onboarding form fully and accurately
- Grant access to your Google Business Profile, or complete verification using our instructions
- Provide photos, logo, and business details in a timely manner
- Avoid hiring third-party SEO providers during your contract term
- Respond to requests from our team within 3 business days
Failure to meet these responsibilities may result in delays, reduced performance, or additional charges.
3. Payment & Subscription Terms
- Services are billed monthly or annually depending on your selection
- Monthly plans renew automatically unless canceled with 30 days’ written notice
- Annual plans are prepaid and non-refundableYour subscription includes all services listed in your selected plan and any chosen add-ons
- A 5% annual rate increase may be applied to cover platform costs and inflation
4. Cancellation & Early Termination
- You may cancel at any time with 30 days’ written notice
- If canceled before the 3-month minimum, you will be charged an early termination fee equal to 50% of the remaining balance
- If you request a website transfer, a one-time fee of $2,500 applies
5. Ownership & Access
- All websites, tools, and systems provided are owned by Home Services Growth Engine
- You are leasing access to our system; you do not own the website unless you pay the transfer fee
- If your subscription is canceled or unpaid, access to your site and tools will be revoked at the end of the billing period
6. Dispute Resolution & Chargebacks
- All disputes must be submitted in writing within 10 business days
- You agree to attempt resolution through negotiation first, followed by binding arbitration in Florida if needed
- You waive the right to initiate chargebacks; chargebacks may result in a$2,500 liquidated damages fee, legal action, and reporting to collections
7. Limitations of Liability
We are not liable for:
- Delays caused by third-party platforms (e.g., Google)
- Changes to Google’s algorithm or policies
- Client inaction or failure to follow instructions
- Loss of access to digital assets due to client-side changes
Our maximum liability is limited to the total amount paid by you in the 3 months prior to any claim.
8. Service Modifications
We reserve the right to update our pricing, service features, or platform capabilities. You will be notified of significant changes in advance. Continued use of our services after such notice constitutes acceptance.
9. Indemnification
You agree to indemnify and hold harmless Home Services Growth Engine from any claims, losses, damages, or expenses arising from:
- Your misuse of our services
- Your failure to comply with laws or regulations (e.g., in SMS/email marketing)
- Any dispute involving your business, staff, or customers
10. Governing Law
This Agreement is governed by the laws of the State of Florida. All disputes, mediation, and legal matters will be handled in Florida.
11. Class Action Waiver
You agree to waive any right to participate in a class-action lawsuit or class-wide arbitration related to our services.
12. Client Agreement Reference
For paying clients, these Terms and Conditions are supplemented by our formal Client Service Agreement, which includes specific terms related to deliverables, onboarding timelines, and dispute procedures.
If any conflict arises between this Terms and Conditions page and a signed Client Agreement, the Client Agreement shall prevail.
By using our services, you confirm that you have read, understood, and agreed to these Terms and Conditions.
